1. Acceptance of Terms

By purchasing or using XeraX ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. We reserve the right to update these terms at any time.

2. Legal Use Only

You are solely responsible for ensuring your use of XeraX complies with all applicable local, national, and international laws. XeraX is designed for:

• Monitoring your own devices
• Monitoring devices you own with the knowledge and consent of the user
• Monitoring minor children's devices as a parent or legal guardian
• Monitoring company-owned devices with employees notified per company policy
• Security research and penetration testing on devices you are authorised to test

Unauthorized surveillance, wiretapping, or interception of communications is illegal in most jurisdictions. XeraX assumes no liability for any unlawful use. Violation of this clause may result in immediate account termination without refund.

3. Consent Requirement

In most jurisdictions, you must obtain explicit consent before monitoring another person's device, even if you own the device. You are responsible for obtaining all required consents. We recommend consulting a lawyer in your jurisdiction before deploying XeraX on any device used by another person.

4. Subscription and Billing

• Subscriptions are billed monthly or annually as selected at checkout.
• Payment is processed by PayPal. By purchasing, you agree to PayPal's Terms of Service.
• Subscriptions automatically renew unless cancelled before the renewal date.
• Prices are in USD and may change with 30 days' notice to existing subscribers.

5. Refund Policy

We offer a 7-day refund policy for all new purchases. If you are unsatisfied within 7 days of your initial purchase, contact us at support@xeraxapp.com for a full refund. Refunds are not available after 7 days or for renewal charges.

6. Account Termination

We reserve the right to terminate or suspend accounts at our discretion, including for:

• Violation of these Terms of Service
• Evidence of illegal or unauthorized surveillance
• Chargebacks or fraudulent payment activity
• Abuse of the support system

Accounts terminated for Terms violations are not eligible for refunds.

7. Limitation of Liability

XeraX is provided "as is" without warranty of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. In no event shall XeraX be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, even if advised of the possibility of such damages. Our total liability to you shall not exceed the amount paid in the 30 days preceding the claim.

8. Intellectual Property

All content, code, trademarks, and materials on xeraxapp.com are owned by XeraX and may not be reproduced without written permission.

9. Privacy

Use of the Service is also governed by our Privacy Policy, incorporated herein by reference.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in the courts of the jurisdiction of the registered operator, as applicable.
